U.S. District Court Judge Karon Bowdre has ruled that the U.S. Army Corps of Engineers has assessed the environmental impact and fulfilled the legal requirements to obtain a permit to build a dam on the Duck River near Cullman, AL, which will permanently block the river and create a 640-acre reservoir. The Alabama Rivers Alliance (ARA), along with plaintiffs Black Warrior Riverkeeper, Friends of the Mulberrry Fork River, and Wild South, had sued the Corps in 2007 to halt the dam, citing environmental concerns over the original 2000 permit. The dam is not a done deal yet, with financing still to be arranged, and ARA Executive Director Cindy Lowry has urged the city and county to look at alternatives, including conservation and efficiency measures, to building the destructive dam.
